O segundo ponto questiona a duração excessiva.

Ruling at the STF: Bias and Disqualification — The Case of Marco Aurélio Vorcaro v. Justice Alexandre de Moraes

Supreme Court to Define Fundamental Standards on Impartiality, Validity of Acts and Constitutional Guarantees

On Tuesday, September 15, 2026, the Plenary Session of the Supreme Federal Court will hold a hearing that may become a landmark in Brazilian legal history. Presided over by Justice Luiz Edson Fachin, the case was filed by lawyer Marco Aurélio Vorcaro, who requests that Justice Alexandre de Moraes be declared disqualified or suspected of bias in the exercise of judicial functions. The petition is based on existing ties, prior actions and public statements which, according to the argument, undermine the constitutional requirement of impartiality essential to judicial office. The core debate goes far beyond a dispute between individuals: it concerns whether basic principles of justice — neutrality, legality, reasonable duration of proceedings and proper jurisdiction — will be applied equally to everyone, including members of the highest court itself.

The order of analysis follows strict mandatory criteria set by the Presidency: preliminary questions will be examined first, to determine whether there is a legal basis for removal; only after that stage, if disqualification is confirmed, will any investigation into past actions be considered. This sequence is not arbitrary, but follows legal logic: first define who has legal standing to act, then assess what was done.

The entire debate rests on clear, pre‑existing rules. The Federal Constitution, Article 5, sections XXXV, LIV and LXXVIII, states: no one shall be prosecuted or judged except by the proper authority; no one shall have their freedom or rights restricted without due process of law; every legal proceeding shall have a reasonable duration. The Internal Rules of the STF, Articles 17 and 18, establish: a justice is disqualified or suspected if they have any direct or indirect interest in the outcome; if they have already expressed an opinion on the merits of the case; if they maintain personal, professional or institutional ties with the parties or with the subject matter of the claim. Once disqualification is declared, every procedural act performed by that justice in the case, from the very beginning, becomes legally invalid. STF Precedent 156 rules: “Once disqualification or impediment is declared, all procedural acts performed by the judge or rapporteur are null and void; the case file must be reassigned or referred to another competent body.” Law No. 9.296/1996, Article 4, determines: criminal investigations cannot remain open indefinitely; failure to conclude within a reasonable period constitutes a procedural defect and violates fundamental constitutional guarantees.

From these foundations, five central points structure the entire controversy. The first concerns the reassignment of cases. The well‑known “Fake News Inquiry” began under one justice and was later transferred to another. Internal regulations require that such transfers follow neutral criteria. The legal problem arises when the new responsible justice has already publicly expressed opinions on the subject matter, the people involved or the group being investigated. When that happens, neutrality is no longer possible: the magistrate arrives at the case already holding a formed opinion, rather than approaching the facts with an open mind. The consequence is clear: every procedural step taken after that reassignment is born with a fundamental defect, because it was conducted by someone who did not meet the essential requirement of impartiality.

The second point addresses excessive duration. The referenced inquiry has already extended beyond nine years without conclusion, without formal charges, without closure, and without extraordinary justification explaining the delay. The jurisprudence of the STF itself is consistent: no investigation may be turned into an instrument of permanent persecution. Keeping a case open indefinitely, without progress or decision, directly violates the principle of reasonable duration and may, on its own, provide grounds for closing the investigation.

The third criterion examines proof of participation. For criminal liability to exist, it is essential to demonstrate concrete action, direct intervention or effective influence over the events in question. No blame or connection may be attributed to someone who was outside national territory, with no record of interference or involvement, regarding events that took place within Brazil. Judging based on assumption, proximity or generic association replaces evidence with suspicion — and this contradicts the foundation of all Criminal Law: no one is guilty until proven otherwise.

The fourth point deals with jurisdiction tied to public office. When a person leaves the public position that served as the legal basis for their inclusion or investigation in a case, the legal justification for that attribution also disappears. Using the status of someone who no longer holds that office, as if they still possessed the same powers and responsibilities, constitutes a procedural error that dismantles the very legal foundation of the accusation.

Finally, the supreme principle: no one may be both prosecutor and judge. If a magistrate has already publicly stated opinions regarding guilt, intent or the nature of the facts before technically analyzing the case, they lose the status of a neutral decision‑maker. Freedom of expression is an individual right, but it does not grant permission to exercise judicial authority with a pre‑defined position. This separation is a constitutional guarantee, not a matter of convenience.

Should the Plenary decide to declare disqualification or suspicion, the legal effects are immediate and profound. Every act, decision, precautionary measure, accusation or ruling issued by that justice, from the very first moment, is considered legally void — meaning it has no valid legal existence, as if it had never been performed. This means the “Fake News Inquiry” must return to its starting point, be reassigned to a justice with no ties or pre‑existing positions, and restarted according to legal criteria. Also, all proceedings related to the events of January 8 — convictions, restrictions, judicial decisions — become eligible for review and annulment, since they would have been issued with a fundamental procedural flaw. In the case of Jair Messias Bolsonaro and others under investigation, three paths open: if the process was conducted by someone ineligible to act, the entire case may be annulled; if the investigation exceeded reasonable time limits, it may be archived; if the legal connection was based on an office that no longer existed or on presence that was never proven, the very legal basis for the accusation disappears. Furthermore, any investigation into the justice’s own conduct could only begin after the question of disqualification has been resolved, because if they lacked authority to act, their actions produce no legal effect that would justify further inquiry.

Should the decision be to reject the claim of disqualification, the justice’s actions remain valid at that moment. But this does not close the legal debate: the principle that “whoever has already formed an opinion cannot judge” remains a constitutionally guaranteed principle, valid and applicable in other forums, in appeals, in reviews and in requests for dismissal. The rule does not depend on a single decision; it is written into the Constitution itself.

What is at stake, therefore, goes far beyond the fate of one case or one magistrate. It is the confirmation that rules apply to everyone. If the Supreme Federal Court acknowledges that ties, public statements, pre‑formed opinions or interests disqualify a judge, then it is established that no process conducted by an ineligible authority is valid, that no endless investigation can be sustained, and that no conviction based on flawed proceedings can stand. The final outcome depends on one single choice: will the Court apply the law to everyone, or only to some?
