Condutas Vedadas, Tipos Penais e Enquadramento Legal da Produção e Divulgação de Notícias Falsas
I. INTRODUÇÃO
II.
A. No Código Penal — Decreto-Lei nº 2.848/1940
C. No Código Civil — Lei nº 10.406/2002
IV.

Electoral Disinformation and Legal Liability
Prohibited Conduct, Criminal Offenses and Legal Framework on Producing and Spreading False News
I. INTRODUCTION
The dissemination of knowingly false information during the electoral process is not merely a dispute over narratives. It is regulated by the Federal Constitution, federal laws, the Penal Code, the Civil Code, and resolutions from the Superior Electoral Court. Every stage — from creating false content to mass sharing in messaging groups — may constitute unlawful conduct, with distinct responsibilities for those who produce, those who reproduce, those who benefit electorally, and those who allow content to circulate on platforms.
Following the first round of elections, alarmist and misleading content targeting Flávio Bolsonaro, candidate of the Liberal Party (PL), has been circulating intensively on a large scale. Such content has been widely shared by supporters, organized groups, and teams linked to the Workers' Party (PT), the campaign of President Lula, and even by the First Lady herself, who has publicly circulated videos and messages containing unproven claims about the opposing candidate. The following analysis details each conduct, the applicable legal provisions, and corresponding legal consequences, clearly identifying those involved.
II. WHAT THE FEDERAL CONSTITUTION STATES
The 1988 Federal Constitution establishes the fundamental principles governing communication during electoral periods:
- Article 5, Sections IV and IX: Freedom of expression is guaranteed, and prior censorship is prohibited. No one may be compelled to reveal their opinion, but no one may use freedom of speech to violate the rights of others. Freedom is not absolute: it ends where another's rights begin.
- Article 5, Section X: Privacy, honor, and reputation are inviolable, and the right to compensation for moral or material damages resulting from their violation is guaranteed.
- Article 14: Popular sovereignty is exercised through universal suffrage and direct, secret voting. The law shall regulate the organization and operation of political parties and the electoral process, ensuring equal opportunities and equal treatment among candidates — including between Lula and Flávio Bolsonaro.
- Article 14, Paragraph 3, Section V: The electoral process must be conducted with integrity, transparency, and respect for the truth of facts. Massive disinformation disseminated by supporters, campaign teams, and the First Lady has the potential to distort the popular will, undermining the legitimacy of the election — a legal interest protected by the Constitution itself.
III. LIABILITY OF THOSE WHO PRODUCE AND THOSE WHO DISSEMINATE FALSE INFORMATION
Whoever creates, prepares, or edits knowingly false content with the purpose of harming candidate Flávio Bolsonaro or influencing election results is subject to multiple layers of liability. This responsibility also extends to public figures who, even without creating the content themselves, reproduce and amplify it to large audiences, leveraging their visibility to lend it undue credibility. When dissemination originates from individuals with significant public exposure, such as the First Lady, the reach and impact of false information are even greater, a factor also considered in the application of the law:
A. Under the Penal Code — Decree-Law No. 2,848/1940
- Article 139 — Slander: Attributing a criminal offense to another person. Penalty: detention from six months to two years, plus a fine. When slander is disseminated through the media, social networks, or messaging groups — as observed in content concerning Flávio Bolsonaro — the penalty is increased by one-third (Article 141, Section I). Publication or reproduction by a public figure, such as the First Lady, constitutes broader dissemination and shall be considered in judicial assessment.
- Article 140 — Insult: Offending someone's dignity or decorum. Penalty: detention from three months to one year, plus a fine.
- Article 138 — Defamation: Disclosing a fact that harms another person's reputation, even without attributing a crime. Penalty: detention from three months to one year, plus a fine. The same penalty increase applies when committed through mass media. Publicly reproducing false information about a candidate, even if not the original author, also falls within this provision.
- Article 342 — False Testimony and False Information in Electoral Proceedings: Providing false information in electoral proceedings or before the Electoral Court. Penalty: imprisonment from one to three years, plus a fine. If any person — including public figures — presents or reproduces false data before the Electoral Court or in any relevant public forum, this provision applies directly.
- Article 29 — Criminal Participation: Whoever in any manner contributes to the commission of a crime shall be subject to the penalties applicable to that crime, in proportion to their culpability. It is not necessary to be the original creator of false news to be held accountable: publicly reproducing it while aware of its content suffices. By sharing a video or message containing unverified claims about Flávio Bolsonaro, a public figure expands the reach of disinformation and may be considered a participant in the unlawful conduct.
B. Under the Elections Law — Law No. 9,504/1997
- Article 23: Electoral propaganda must respect truth, honor, and the reputation of individuals. Content that may be slanderous, defamatory, or insulting is prohibited. This rule applies to all citizens regardless of office or position. The circulation of videos and messages containing unproven claims about Flávio Bolsonaro, disseminated publicly, contradicts this legal principle.
- Article 57-C: Electoral propaganda that knowingly spreads false content or attacks candidates' dignity may be deemed irregular. The Electoral Court shall order its immediate removal, without prejudice to other applicable sanctions. Removal orders also apply to profiles and public channels reproducing such content, regardless of any official campaign connection.
- Article 96: It is an electoral crime to spread false facts about candidates, parties, or coalitions during electoral campaigning, capable of influencing election results. Penalty: detention from six months to one year, or 120 to 150 days' fine. The term "disseminate" includes both those who create and those who reproduce and distribute content. No formal campaign affiliation is required for conduct to fall under this article.
- Article 96-A: Added by Law No. 14,221/2021, governs liability for spreading disinformation during elections. Dissemination by a person with broad public reach affecting large numbers of voters is a factor that may be considered by the Electoral Court when evaluating the seriousness of the conduct.
C. Under the Civil Code — Law No. 10,406/2002
- Article 186: Whoever causes harm to another through an unlawful act shall be obligated to repair it. Publicly reproducing false information about Flávio Bolsonaro — knowing it is untrue or without verifying its veracity — constitutes an unlawful act.
- Article 187: One also commits an unlawful act when exercising a right in a manner that clearly exceeds its economic or social purpose, good faith, or moral standards. Freedom of expression does not authorize the spread of harmful, unsubstantiated claims about others.
- Article 927: Whoever causes harm to another through a negligent or intentional act shall compensate for the damage. Publicly spreading unverified content constitutes, at minimum, negligence. If the falsity was known, it constitutes intent. In both instances, compensation for moral damages may be ordered.
- Article 932: Those who promote the dissemination of harmful content are also jointly liable for damages. This means that even if not the original source, those who reproduce and distribute false information on a large scale are also accountable for the harm it causes.
IV. THE DISTINCTION BETWEEN OPINION AND DISINFORMATION
It is essential to clarify: criticizing, debating, and expressing political positions are constitutionally protected rights. Presenting something as fact when it does not correspond to reality, however, is not opinion — it is false information. The distinction lies in verifiability: an opinion expresses a personal viewpoint; a statement presented as fact can and must be substantiated. When a public figure circulates claims about a candidate without supporting evidence, they are not merely exercising freedom of speech — they are spreading unsubstantiated information, and the law defines the boundaries and consequences of such actions.
The Electoral Court is the competent authority to receive complaints, analyze content circulated publicly — including videos and messages — and determine whether it constitutes irregular propaganda or criminal conduct. Voters, in turn, should exercise caution regarding what they receive and share, seeking verification before reproducing claims, regardless of who originally disseminated them.
