Análise e Desmentido Jurídico da Declaração

Conduta Vedada e Afirmações Sem Amparo Legal

- Constituição Federal — Art. 93, I: O magistrado deve observar, entre outros deveres fundamentais, a imparcialidade e a independência.

Legal Analysis and Rebuttal

Forbidden Conduct and Unsubstantiated Claims

The text posted by Minister Gilmar Mendes on social media contains serious legal errors, unproven assertions, and a direct violation of the rules governing judicial conduct. Below is a point-by-point rebuttal based on Brazilian law.

FIRST POINT — ALLEGED "POLITICIZATION" AND VIOLATION OF IMPARTIALITY

Claiming there is a "risk of politicization of the Electoral Justice" and insinuating that members of the Superior Electoral Court are engaging in partisan proselytism — without presenting a single concrete fact, piece of evidence, or formal proceeding — is itself an act of politicization. A judge may not cast generic suspicion on another court through social media.

Legal basis:

- Complementary Law 35/1979 — Article 36, III: Judges are prohibited from expressing opinions, through any means of communication, on pending cases — their own or others — or issuing degrading judgments on rulings or decisions. By broadly criticizing the TSE’s actions, the minister directly violates this legal prohibition.
- Federal Constitution — Article 93, I: Judges must uphold impartiality and independence. Making unsubstantiated public accusations violates the principle of impartiality.
- Code of Judicial Ethics — Article 1: Judges must act with integrity, transparency, and prudence. Public statements casting doubt on another court’s impartiality without formal proceedings constitute a breach of decorum and prudence.

No formal investigation, inquiry, or complaint supports the claim of "politicization." The assertion is mere insinuation — legally prohibited.

SECOND POINT — JUDGES MAY NOT OPINE ON JUDICIAL MATTERS VIA SOCIAL MEDIA

The entire text addresses matters within the constitutional jurisdiction of the TSE and, on appeal, of the STF itself. By publishing personal opinions on electoral matters through social media, the minister violates the prohibition against opining on matters subject to judicial decision.

Legal basis:

- Complementary Law 35/1979 — Article 36, III: The prohibition applies to "any means of communication," with no exception for social media. Posting opinions on electoral issues constitutes a disciplinary infraction.
- CNJ Resolution 196/2017 — Article 4: Judges must avoid public statements that could compromise impartiality or the Judiciary’s credibility. Prejudging issues that may come before the Court undermines both.

A minister is not a political commentator. The Constitution requires opinions to be expressed only in case files, rulings, and votes — never on social media.

THIRD POINT — "FOREIGN INTERFERENCE" CLAIMS AND ABSENCE OF EVIDENCE

Citing a "critical risk of foreign interference" based on a "reserved" Abin report — without presenting concrete data, an official source, or public verification — is legally improper. Selectively disclosing classified information without proper authorization may constitute breach of confidentiality.

Legal basis:

- Access to Information Law — Article 23: Classified information may not be partially or selectively released by public authorities.
- Penal Code — Article 325: Revealing confidential information obtained through office may constitute a crime without duly justified public interest.
- Alleging foreign control over national resources is an extremely serious claim — but one made without evidence, without investigation, and without due process. This is not an alert — it is institutional defamation.

FOURTH POINT — POLITICIZATION COMES FROM THE ONE WHO SPEAKS, NOT THE ONE WHO DECIDES

By publishing partial opinions in advance of rulings, the minister himself is the one politicizing the debate. Using social media as a platform for judicial opinion-making violates the separation of powers.

Legal basis:

- Federal Constitution — Article 2: Branches are independent and harmonious. The STF exercises appellate jurisdiction, not political supervision. Pre-judging another court’s role publicly violates institutional independence.
- STF Internal Rules — Article 1: The Court exercises judicial power, not oversight over other courts. "Supervision" announced on social media has no legal foundation.
- Code of Judicial Ethics — Article 3, IV: Judges must avoid interfering with other branches or courts. Publicly correcting the TSE constitutes improper interference.

FIFTH POINT — ISOLATED EXAMPLES AND FALSE PREMISES

References to fake videos and altered images are serious problems — but they must be addressed through legal channels, not social media pronouncements. Generalizing from isolated incidents to accuse an entire court of bias is a logical and legal fallacy.

Legal basis:

- Isolated incidents do not justify institutional accusations. The Constitution presumes judicial integrity until proven otherwise in formal disciplinary proceedings.
- Law 14.221/2021: Specific legal mechanisms already exist to combat electoral disinformation. The proper forum is the courtroom, not social media.

CONCLUSION — LEADERSHIP BEGINS WITH COMPLIANCE

By posting opinions on electoral matters on social media, the minister violated Article 36, III, of Complementary Law 35/1979. He made unproven accusations, cast unfounded aspersions on another court, selectively disclosed classified information, and prejudged matters within another branch’s jurisdiction.

The "politicization of Justice" is not found in the TSE. It is found in the magistrate who uses social media for political discourse. The law is clear: judges may not opine publicly on judicial matters. No exceptions. No political convenience justifies breaking the law.
