No exercício dessa atribuição, descobriu que o Delegado‑Geral Andrei Rodrigues e o diretor de inteligência Leandro Almada elaboravam relatórios secretos de inteligência sobre o próprio Ministro Relator e sobre o Advogado‑Geral da União, enviando esse material diretamente ao Ministro Alexandre de Moraes. Tais ações ocorreram sem qualquer ordem judicial, sem justificativa legal e fora de qualquer procedimento formal. Trata‑se de uso indevido da estrutura de segurança pública para vigiar e atacar autoridade judicial responsável por investigação sensível, além de configurar conflito de interesses direto, pois Andrei Rodrigues participava diretamente da condução dos processos que o Ministro Mendonça comandava.
 
Diante disso, afastou preventivamente as autoridades envolvidas e comunicou a Corregedoria da Polícia Federal para que fosse instaurada investigação administrativa. Essa medida encontra amparo expresso no Artigo 21 do Regimento Interno, que garante ao Relator o poder de determinar tudo o que for necessário para evitar que o processo seja obstruído, desviado ou comprometido.
 
O fundamento legal é preciso e inquestionável: consta no Artigo 21, parágrafo 2º, que As medidas cautelares determinadas pelo Relator produzem efeito imediato, até que o Plenário decida em contrário. MINISTRO DINO — TOTALMENTE ERRADO — ATO NULO DE PLENO DIREITO
 
Interveio em processo que jamais lhe foi distribuído, que não estava sob sua responsabilidade e sobre o qual não possuía qualquer competência. Essa conduta viola de forma direta e explícita o Artigo 13 do Regimento Interno do STF, que estabelece: Nenhum Ministro pode intervir, decidir, modificar ou revogar qualquer ato praticado pelo Relator em processo distribuído a outro.
 
Além de invadir esfera alheia, utilizou argumentos jurídicos sem relação com a realidade dos fatos. Alegou que a parte que havia solicitado a medida não teria legitimidade para tanto — quando, na verdade, o Ministro Mendonça não agiu por pedido de quem quer que fosse. Agiu porque constatou, dentro dos autos e por meio de provas próprias, que a autoridade responsável pela investigação estava espionando a própria autoridade judiciária e desviando informações sigilosas. A legitimidade do Relator não depende de quem pede, mas sim de ser ele quem conduz o processo e tem o dever constitucional e regimental de protegê‑lo.
 
Ainda assim, anulou a suspensão e devolveu os cargos como se tivesse autoridade para decidir sobre o caso. Não tinha. Por ter sido proferida por quem não detém competência legal para agir naquele processo, a decisão não gera nenhum efeito jurídico válido: é nula desde a origem.
 
PRESIDENTE FACHIN — ERRO GRAVE, CONSCIENTE E FUNDAMENTAL
 
A falha central está na confusão deliberada entre duas figuras jurídicas distintas: conflito de competência e invasão de competência. Essa distinção é a chave para compreender todo o equívoco:
 
Conflito de competência: ocorre quando dois ministros consideram‑se competentes para atuar no mesmo processo, porque a distribuição ainda não está clara ou definitiva. Nesse caso, sim, o Presidente pode intervir para organizar a questão e levá‑la ao Plenário.
 
O que aconteceu aqui: Um ministro — Mendonça — era o único competente, por lei e por distribuição definitiva. Outro — Dino — não tinha nenhum direito de agir, entrou em assunto que não lhe pertencia e praticou ato expressamente proibido pelo Regimento. Isso não é conflito; é violação manifesta de regra.
 
Diante desse quadro, o que deveria ter feito era claro e simples:
 
1. Reconhecer que a decisão de Mendonça estava amparada em lei e possuía força executiva imediata, mantendo‑a em vigor até que o Plenário julgasse o mérito;
2. Declarar nulo e sem efeito o ato do Ministro Dino, por absoluta falta de competência;
3. Convocar o Plenário para analisar o assunto — sem, contudo, retirar a proteção necessária ao andamento da investigação.
 
O que, de fato, fez, foi inteiramente diferente:
 
1. Suspendeu as duas decisões ao mesmo tempo, igualando a decisão correta e válida à decisão ilegal e nula, como se fossem duas posições iguais e legítimas;
2. Permitiu que o Delegado‑Geral Andrei Rodrigues voltasse ao cargo e continuasse comandando investigações sensíveis — incluindo aquelas em que ele próprio figura como suspeito — dando‑lhe tempo e liberdade para que provas fossem ocultadas, informações alteradas ou pessoas protegidas;
3. Retirou da competência do Ministro Mendonça também a investigação aberta contra o Ministro Alexandre de Moraes, baseada nos mesmos fatos, e centralizou tudo sob sua própria gestão, sem ter qualquer poder legal para redistribuir ou assumir processo alheio;
4. Adiou o julgamento final para o dia 15, deixando um vácuo de mais de uma semana em que nenhuma medida cautelar vigora, ninguém responde pelo controle e quem já estava comprometido permanece com todo o poder de ação.
 
A violação principal está no princípio básico de organização do Tribunal: o Presidente do STF não é juiz dos juízes e não tem competência para anular ou suspender decisões de Relator por conta própria. Esse poder pertence exclusivamente ao Plenário.
